1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "You") and OnXBit LTD ("Company," "we," "us," or "our"), governing your access to and use of the OnXBit website, mobile application, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must strictly stop using our Services immediately.
2. Eligibility
By using OnXBit, you represent and warrant that:
- You are at least 18 years old or of legal age to form a binding contract under applicable law.
- You are not a resident of any Restricted Jurisdiction (including, but not limited to, the United States, North Korea, Iran, and other sanctioned regions).
- You have not been previously suspended or removed from using our Services.
- You have full power and authority to enter into this agreement without violating any other agreement to which you are a party.
3. Account Registration & Security
3.1 Account Creation
In order to use certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Security
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify OnXBit of any unauthorized use of your account or any other breach of security. OnXBit cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
4. Trading Services
OnXBit provides a platform for trading Digital Assets and Derivatives. You acknowledge that:
- Execution: Orders are executed based on our matching engine's logic. Once an order is executed, it is irreversible.
- Availability: We strive to provide 24/7 service, but do not guarantee that the Services will be available without interruption.
- Modifications: We reserve the right to modify, suspend, or discontinue any part of our Services at any time with or without notice.
5. Risk Disclosure
Trading cryptocurrencies and derivatives involves a high degree of risk.
You acknowledge and agree that you are solely responsible for your trading decisions. You should be aware that the risk of loss in trading or holding Digital Assets can be substantial. You can lose your entire investment, especially when using leverage.
OnXBit is not responsible for any losses incurred due to market fluctuations, technical failures, or your own errors.
6. Fees & Payments
You agree to pay OnXBit the fees set forth in our Fee Schedule, which may be updated from time to time. You authorize us to deduct any applicable fees directly from your account balance.
7. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ONXBIT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
